SWIS SPhone Terms of Service

1. Description of Service

SWIS SPhone is a free dialer application with integrated scam risk detection overlays. The app contains no advertisements, no subscriptions, no in-app purchases, and no user accounts.

2. No Guarantee of Scam Prevention

The risk detection engine operates using probabilistic and heuristic analysis. False positives and false negatives may occur. The app does not guarantee scam prevention and does not provide legal, financial, or professional advice.

3. User Responsibility

Users remain solely responsible for decisions made during or after phone calls. The app provides risk indicators only and must not be solely relied upon.

4. Disclaimer of Warranties

The application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including merchantability, fitness for a particular purpose, or accuracy of warnings.

5. Limitation of Liability

To the maximum extent permitted under Indian law, SWIS Technologies shall not be liable for financial loss, fraud-related damages, data loss, or indirect or consequential damages arising from use of the app.

6. Force Majeure

We are not liable for service interruption caused by telecom failures, regulatory changes, operating system restrictions, or circumstances beyond reasonable control.

7. Intellectual Property

All software, algorithms, branding, and design elements remain the exclusive property of SWIS Technologies. Reverse engineering or redistribution is prohibited.

8. Governing Law

These Terms are governed by the laws of India. Any disputes shall fall under the jurisdiction of Indian courts.

9. Entire Agreement

These Terms constitute the entire agreement between the user and SWIS Technologies regarding use of the application. They supersede any prior agreements, communications, or representations, whether oral or written, relating to the application.

10. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
